South Korea e-Cigarette Regulatory Report 2021 – ResearchAndMarkets.com

E-cigarettes with nicotine are regulated as tobacco products under the Tobacco Business Act. Precisely, tobacco is any product that contains or is derived from tobacco leaves.

For this reason, importers may try to circumvent requirements placed on tobacco products by declaring them as containing extracts from tobacco stems or roots. To tackle this problem, the current government – just like the previous – is trying to redefine tobacco products as those being derived from any part of the tobacco plant.

E-cigarettes are defined by the National Health Promotion Act Enforcement Decree as a product made to produce the same effect as smoking by inhaling a nicotine solution or tobacco via an electronic device.

Nicotine-free vapour products are classified as a quasi-drug and the Ministry of Food and Drug Safety (MFDS) must approve their sale.

E-cigarettes without nicotine fall under the quasi-drug group 2, which are the products that have minimal effect or do not have a direct effect on humans (other products in the same category are mouthwash and anti-hair loss products).
