This section of the Act deals with “corporate offences of failure to prevent facilitation of tax evasion,” setting out offences that hold corporations and partnerships criminally liable when they fail to prevent their employees, agents, or others who provide services on their behalf from criminally facilitating tax evasion.
The Act, which targets corruption, money laundering and tax evasion, aims to recoup criminal assets and is part of the UK Governments strategic approach to reducing financial crime. While tax evasion is already an offence, this Act widens the net of culpability to every employee in an organisation not just senior managers.
Kate Carter added, Since the Act makes it clear that everyone in an organisation has a responsibility to prevent tax evasion, this Engage in Learning e-learning programme should be much in demand from those who want their organisation and its employees to remain operating within the laws demands.
